Refund and Cancellation Conditions

CONSUMER RIGHTS - WITHDRAWAL - CANCELLATION REFUND CONDITIONS

In this text, every field referred to as Seller represents MUTEKS MUTLUBAŞLAR ÖRME İHTİSAS SANAYİ İÇ VE DIŞ TİCARET LTD. ŞTİ. Every field referred to as Buyer is used for buyers who purchase products or services from MUTEKS MUTLUBAŞLAR ÖRME İHTİSAS SANAYİ İÇ VE DIŞ TİCARET LTD. ŞTİ.

GENERAL:

  1. If you place an order electronically through the website you are using (www.roosac.com), you are deemed to have accepted the preliminary information form and distance sales contract presented to you.
  2. Buyers are subject to the provisions of Consumer Protection Law No. 6502 and Distance Contracts Regulation (RG:27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.
  3. Shipping costs for product delivery will be paid by buyers.
  4. Each purchased product is delivered to the person and/or organization at the address specified by the buyer, not exceeding the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.
  5. The purchased product must be delivered complete and in accordance with the specifications stated in the order, along with documents such as warranty certificate and user manual, if any.
  6. In case it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the Buyer does not pay for the product purchased or cancels it in bank records, the Seller's obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If, after the product is delivered, it is determined that the credit card used by the buyer for payment has been used unlawfully by unauthorized persons, and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the SELLER within 3 days, with shipping costs to be borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If force majeure events that the Seller cannot foresee occur and the product cannot be delivered on time, the situation is reported to the Buyer. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if payment was made in cash, this fee will be paid to them in cash within 14 days of cancellation. If the Buyer made the payment by credit card and cancels, the product price will be refunded to the bank within 14 days from this cancellation, but it is possible that the bank will transfer it to the buyer's account within 2-3 weeks.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The Buyer will inspect the goods/services subject to the contract before receiving them; they will not accept damaged and defective goods/services such as dented, broken, torn packaging, etc. from the shipping company. The received goods/service will be considered undamaged and intact. The BUYER must carefully protect the goods/service after delivery. If the right of withdrawal is to be used, the goods/service should not be used. The Invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER can use the right to withdraw from the contract by rejecting the goods without any legal and criminal liability and without showing any reason, provided that they notify the SELLER through the contact information below within 14 (fourteen) days from the date of delivery of the product they purchased to themselves or to the person/organization at the address they specified.

PERIOD OF RIGHT OF WITHDRAWAL:

  1. If what the Buyer has purchased is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be used in service contracts where the provision of the service has begun with the consumer's approval before the end of the withdrawal right period.
  2. Costs arising from the use of the right of withdrawal belong to the SELLER.
  3. For the right of withdrawal to be used, written notification must be made to the SELLER within 14 (fourteen) days by registered mail, fax, or email, and the product must not have been used within the framework of the provisions of "Products That Cannot Be Returned" regulated in this contract.

USING THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to a third party or to the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning. Order returns whose invoices are issued in the name of institutions cannot be completed if a RETURN INVOICE is not issued.)
  2. Return form, the box, packaging of the products to be returned, along with standard accessories if any, must be delivered complete and undamaged.

Return Conditions:

  1. The SELLER is obliged to return the total price and documents that put the BUYER in debt to the BUYER within 10 days from the receipt of the withdrawal notification and to take back the goods within 20 days.
  2. If there is a decrease in the value of the goods due to a reason arising from the BUYER's fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or product within the period of the right of withdrawal.
  3. If the campaign limit amount organized by the SELLER falls below due to the use of the right of withdrawal, the discount amount benefited within the scope of the campaign is canceled.

PRODUCTS THAT CANNOT BE RETURNED:

  1. According to the Regulation, it is not possible to return underwear parts, swimwear and bikini bottoms, makeup materials, disposable products, goods that are in danger of spoiling quickly or that may expire, products that are not suitable for return in terms of health and hygiene if the packaging is opened by the BUYER after being delivered to the BUYER, products that mix with other products after delivery and cannot be separated by nature, goods related to periodicals such as newspapers and magazines except those provided under the Subscription agreement, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer, and sound or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging has been opened by the BUYER. In addition, according to the Regulation, it is not possible to use the right of withdrawal for services whose provision has begun with the consumer's approval before the end of the right of withdrawal period.
  2. For cosmetic and personal care products, underwear products, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untested, undamaged, and unused.

DEFAULT STATUS AND LEGAL CONSEQUENCES

  1. If the BUYER defaults when making payment transactions with a credit card, they accept, declare, and undertake that they will pay interest within the framework of the credit card agreement between the card owner bank and themselves and will be responsible to the bank. In this case, the relevant bank may resort to legal means; may request the costs and attorney's fee from the BUYER, and in any case, if the BUYER defaults due to their debt, the BUYER accepts to pay the damage and loss suffered by the SELLER due to the delayed performance of the debt.

  1. You can make Bank Transfer or EFT (Electronic Fund Transfer).
  2. With your credit cards through our website, you can benefit from online single payment or online installment options with any credit card. In your online payments, the amount will be charged from your credit card at the end of your order.
